Artistic Expressions: Education on finding errors
in the investigations of the wrongfully accused
In TUNNEL VISION cases police detectives assume guilt within a few moments or days of a crime, seeming to disregard evidence that would point in any other direction. Investigators depend on educated hunches and personal feelings to direct the investigation even if they lack solid evidence. The lack of solid evidence such as physical evidence, DNA, reliable eyewitness testimony, credible confession, and motive does not motivate a police officer against making an arrest in a tunnel vision case.
Often times charges are filed and are used as leverage in plea bargaining. If an innocent person is charged with a crime, it is up to him/her to prove that she is innocent. Prosecutors have dominion control and authority to charge someone with a crime. There are no checks and balances that govern this. In the real world, prosecutors should only bring charges only if they can be substantiated by admissible evidence at trial.
The discretion of a prosecuting attorney is broad and subject to almost no judicial review. It is practically impossible to prove that a prosecuting attorney has abused his or her discretion. One the most damaging misconducts by police and prosecutors is the failure to turn over exculpatory information to the defense. Police and prosecutors know the evidence that suggests innocence. If the defense is deprived of this information, it is difficult to prove a person’s innocence. It is human nature to want to win, and turning over all of the evidence including exculpatory evidence makes obtaining a conviction more difficult.
Artistic Expressions LLC was created by Artis White on June 23, 2002, one year after his wife Bernita White was killed with a high powered rifle while walking with their daughter at the Potter Park Zoo in Lansing, Michigan. Artis who is currently a Sergeant with the Michigan State Police (and Lansing Police Department’s only falsely accused suspect in this case) is frustrated with the lackluster investigative progress by the Lansing Police Department. Artistic Expressions LLC, learning the TRUTH through ART is a result of personal interviews, surveys, police documents, media articles etc. that hopefully, will bring closure to this case, and others throughout the country that are very similar.
